اتهامات بريطانية لستارمر بسبب دوره في حرب العراق.. ما القصة؟ – أخبار السعودية – كورا نيو
كشفت صحيفة «التليغراف» البريطانية عن دور رئيس الوزراء البريطاني كير ستارمر كمحامٍ رئيسي في قضية حقوقية عام 2007، ساهمت في إعادة فتح تحقيقات جنائية في وفيات عراقيين خلال الحرب على العراق، مما أدى إلى ملاحقة مئات الجنود البريطانيين بتهم ارتكاب جرائم حرب أو انتهاكات.
وبحسب الوثائق القضائية التي حصلت عليها الصحيفة، عمل ستارمر الذي كان آنذاك محامي حقوق إنسان بارزاً بشكل مجاني إلى جانب صديقه اللورد هيرمر الذي أصبح الآن المدعي العام في تقديم مذكرة قانونية في قضية Al-Skeini and others v Secretary of State for Defence، التي رفعها أهالي ستة عراقيين قتلوا على يد قوات بريطانية في البصرة عام 2003.
وجادل ستارمر وهيرمر بأن اتفاقية حقوق الإنسان الأوروبية تنطبق على القوات البريطانية في العراق، معتبرين أن التحقيقات العسكرية السابقة «سطحية وغير مستقلة»، وطالبوا بإعادة التحقيق في حالة جندي بريطاني الرقيب ريتشي كاتيرال الذي أطلق النار على عراقي مسلح وتمت تبرئته مرتين سابقاً.
تحقيقات مستقلة جديدة
ووفقاً للصحيفة البريطانية أدى ذلك في النهاية إلى حكم من المحكمة الأوروبية لحقوق الإنسان عام 2011 يلزم بريطانيا بإجراء تحقيقات مستقلة جديدة.
وأدت القضية إلى توسيع الوحدة التي حققت في آلاف الادعاءات، معظمها جاء من مكتب المحامي فيل شاينر الذي أُقصي من المهنة لاحقاً وأدين بالاحتيال عام 2024 بسبب اختلاق أدلة ودفع وسطاء في العراق لجمع شهادات، وأدت التحقيقات إلى سنوات من الملاحقات القضائية لجنود بريطانيين، كثير منهم تمت تبرئتهم لاحقاً، بتكلفة ضريبية هائلة.
وأعرب الرقيب كاتيرال الذي طورد لـ13 عاماً قبل تبرئته نهائياً عن غضبه قائلاً لـ«التليغراف»: «أنا محبط جداً أن كير ستارمر ساعد في رفع هذه القضية ضدي.. هو الآن رئيس الوزراء ويجب أن يعتذر لي»، كما اتهم الوزير السابق لشؤون المحاربين القدامى جوني ميرسر ستارمر بـ«إطلاق حملة مطاردة» ضد الجنود البريطانيين.
ورداً على التقرير، أكد «داونينغ ستريت» أن ستارمر لم يمثل أهالي العراقيين مباشرة، بل تدخل كـ«مساعد للمحكمة في نقاط قانونية» نيابة عن منظمات حقوقية مثل أمنستي إنترناشونال وليبرتي، وأن دوره كان محايداً.
The British newspaper “The Telegraph” revealed the role of British Prime Minister Keir Starmer as a lead lawyer in a legal case in 2007, which contributed to the reopening of criminal investigations into the deaths of Iraqis during the Iraq war, leading to the prosecution of hundreds of British soldiers on charges of war crimes or violations.
According to court documents obtained by the newspaper, Starmer, who was then a prominent human rights lawyer, worked pro bono alongside his friend Lord Hamer, who is now the Attorney General, in submitting a legal memorandum in the case of Al-Skeini and others v Secretary of State for Defence, which was brought by the families of six Iraqis killed by British forces in Basra in 2003.
Starmer and Hamer argued that the European Convention on Human Rights applied to British forces in Iraq, considering that previous military investigations were “superficial and not independent,” and they called for a reinvestigation into the case of British soldier Sergeant Ritchie Catterall, who shot an armed Iraqi and had been acquitted twice before.
New Independent Investigations
According to the British newspaper, this ultimately led to a ruling from the European Court of Human Rights in 2011 requiring Britain to conduct new independent investigations.
The case led to the expansion of the unit that investigated thousands of allegations, most of which came from the office of lawyer Phil Shiner, who was later struck off the profession and convicted of fraud in 2024 for fabricating evidence and paying intermediaries in Iraq to gather testimonies. The investigations resulted in years of prosecutions of British soldiers, many of whom were later acquitted, at a huge taxpayer cost.
Sergeant Catterall, who was pursued for 13 years before being finally acquitted, expressed his anger, telling “The Telegraph”: “I am very frustrated that Keir Starmer helped raise this case against me… He is now the Prime Minister and should apologize to me.” Former Minister for Veterans Affairs Johnny Mercer accused Starmer of “launching a witch hunt” against British soldiers.
In response to the report, “Downing Street” confirmed that Starmer did not represent the families of the Iraqis directly, but intervened as a “friend of the court on legal points” on behalf of human rights organizations such as Amnesty International and Liberty, and that his role was neutral.
