المحكمة العليا تُجمِّد 4 مليارات دولار من قسائم طعام 42 مليون أمريكي – أخبار السعودية – كورا نيو
في قرار مفاجئ أصدرته المحكمة العليا الأمريكية، مساء الجمعة، سمحت لإدارة الرئيس دونالد ترمب بتأجيل دفع نحو 4 مليارات دولار كانت مطلوبة لتمويل كامل برنامج المساعدات الغذائية (SNAP)، المعروف بـ«قسائم الطعام» لشهر نوفمبر، والذي يستفيد منه 42 مليون أمريكي من ذوي الدخل المنخفض.
القرار، الذي صدر كـ«أمر إيقاف إداري مؤقت» من القاضية الليبرالية كيتانجي براون جاكسون، يمنح محكمة الاستئناف الفيدرالية الأولى في بوسطن مهلة إضافية للبت في طلب الإدارة بتمويل جزئي فقط قدره 4.65 مليار دولار، بدلا من التكلفة الكلية الشهرية التي تراوح بين 8.5 و9 مليارات دولار.
القرار جاء بعد ساعات من حكم أصدره القاضي الفيدرالي جون ماكونيل في رود آيلاند الخميس، والذي ألزم وزارة الزراعة الأمريكية (USDA) بدفع المبلغ الكامل فورا باستخدام احتياطيات طارئة من برنامج تغذية الأطفال المدعوم بـ23.35 مليار دولار من رسوم التعريفة الجمركية.
واتهم ماكونيل (المعين من الرئيس الديمقراطي السابق باراك أوباما) إدارة ترمب بـ«حجب المساعدات لأسباب سياسية»، معتبرا أن التأخير «يُسبب فوضى إغلاق حكومي إضافية عبر حكم قضائي».
نشاط قضائي في أسوأ صوره
من جانبها، احتفت المدعية العامة بام بوندي بالقرار العالي عبر منشور على منصة «إكس»، واصفة حكم ماكونيل بـ«النشاط القضائي في أسوأ صوره».
وكانت وزارة العدل قد حذرت المحكمة العليا من أن السماح بحكم ماكونيل سيؤدي إلى «هجوم على الخزينة عبر أمر قضائي»، خصوصا مع إغلاق الحكومة الفيدرالية المتواصل.
في البداية، خططت الإدارة لتعليق البرنامج بالكامل في نوفمبر بسبب نفاد التمويل، لكن ماكونيل أمر الأسبوع الماضي باستخدام احتياطيات الطوارئ، ثم أكمل الحكم الخميس بإلزام الوزارة بسد العجز من ميزانية منفصلة.
التحالف القانوني الذي رفع الدعوى -يضم مدنا ونقابات ومنظمات غير ربحية ممثلة بمجموعة «ديمقراطية فوروارد» الليبرالية- قال لمحكمة الاستئناف إن تعليق الحكم «سيُسبب ضررا لا يُحتمل لنحو واحد من كل ثمانية أمريكيين».
ارتباك الولايات وغضب الديمقراطيين
وقبل ساعات من قرار المحكمة العليا، أرسلت وزارة الزراعة مذكرة للولايات تفيد بأنها «تعمل على الامتثال» لحكم ماكونيل، مما دفع ولايات مثل نيويورك ونيوجيرسي وماساتشوستس لإصدار تعليمات فورية لوكالاتها بصرف المزايا كاملة، لكن قرار المحكمة العليا أعاد الكرة إلى ملعب الاستئناف، مما أثار ارتباكا واسعا.
الحاكمة الديمقراطية لماساتشوستس مورا هيلي، من جانبها، هاجمت ترمب قائلة: «الرئيس ترمب لم يكن يجب أن يضع الشعب الأمريكي في هذا الموقف أبدا».
ورفضت محكمة الاستئناف الأولى طلب الإدارة بإيقاف إداري فوري، لكن لجنة من ثلاثة قضاة معينين من رؤساء ديمقراطيين وعدت بالبت «في أسرع وقت ممكن».
أزمة إنسانية غير مسبوقة
ولأول مرة في تاريخ البرنامج الممتد 60 عاما، توقفت المزايا مطلع نوفمبر، مما دفع المستفيدين -الذين يقل دخلهم عن 130% من خط الفقر الفيدرالي- إلى اللجوء لمخازن الطعام المرهقة أصلا، أو التخلي عن أدويتهم لتوفير الطعام.
كما أن الحد الأقصى للمزايا في العام المالي 2026 هو 298 دولارا للفرد الواحد و546 دولارا لأسرة من شخصين.
رئيسة «ديمقراطية فوروارد» سكاي بيريمان قالت لقناة MSNBC: «المحاكم كانت واضحة جدا: هذه الإدارة ليست فقط مخولة قانونا بدفع هذه المبالغ، بل ملزمة بها».
In a surprising decision issued by the U.S. Supreme Court on Friday evening, it allowed the administration of President Donald Trump to delay the payment of nearly $4 billion that was required to fully fund the Supplemental Nutrition Assistance Program (SNAP), known as “food stamps,” for November, which benefits 42 million low-income Americans. 
The decision, which was issued as a “temporary administrative stay” by liberal Justice Ketanji Brown Jackson, gives the First Circuit Court of Appeals in Boston additional time to consider the administration’s request for only partial funding of $4.65 billion, instead of the total monthly cost ranging between $8.5 and $9 billion.
The decision came hours after a ruling by federal judge John McConnell in Rhode Island on Thursday, which mandated the U.S. Department of Agriculture (USDA) to immediately pay the full amount using emergency reserves from the $23.35 billion child nutrition program funded by tariff fees.
McConnell (appointed by former Democratic President Barack Obama) accused the Trump administration of “withholding assistance for political reasons,” considering that the delay “causes additional government shutdown chaos through judicial ruling.”
Judicial Activism at Its Worst
For her part, Attorney General Pam Bondi celebrated the high court’s decision through a post on the platform “X,” describing McConnell’s ruling as “judicial activism at its worst.”
The Justice Department had warned the Supreme Court that allowing McConnell’s ruling would lead to “an assault on the treasury through a court order,” especially with the ongoing federal government shutdown.
Initially, the administration planned to suspend the program entirely in November due to a funding shortfall, but McConnell ordered last week the use of emergency reserves, then completed the ruling on Thursday by mandating the department to cover the deficit from a separate budget.
The legal coalition that filed the lawsuit – which includes cities, unions, and nonprofit organizations represented by the liberal group “Democracy Forward” – told the appeals court that suspending the ruling “would cause irreparable harm to about one in eight Americans.”
Confusion Among States and Anger from Democrats
Hours before the Supreme Court’s decision, the USDA sent a memo to states indicating that it was “working to comply” with McConnell’s ruling, prompting states like New York, New Jersey, and Massachusetts to issue immediate instructions to their agencies to disburse the full benefits, but the Supreme Court’s decision returned the matter to the appeals court, causing widespread confusion.
The Democratic governor of Massachusetts, Maura Healey, attacked Trump, saying: “President Trump should never have put the American people in this position.”
The First Circuit Court of Appeals rejected the administration’s request for an immediate administrative stay, but a panel of three judges appointed by Democratic presidents promised to rule “as soon as possible.”
Unprecedented Humanitarian Crisis
For the first time in the 60-year history of the program, benefits were halted at the beginning of November, forcing beneficiaries – who earn less than 130% of the federal poverty line – to turn to already strained food pantries or forgo their medications to afford food.
The maximum benefits for the fiscal year 2026 are $298 per individual and $546 for a two-person household.
Sky Pearman, head of “Democracy Forward,” told MSNBC: “The courts have been very clear: this administration is not only legally authorized to pay these amounts, but is obligated to do so.”
