أمر قاضٍ فيدرالي أمريكي، مساء السبت، بالإفراج عن أدريان كونيجو أرياس ونجله البالغ من العمر خمس سنوات ليام كونيجو راموس، بعد أن احتجزتهما سلطات الهجرة خلال مداهمة نفذتها في ولاية مينيسوتا.
وبحسب وكالة رويترز، كان الطفل ليام قد ظهر في صورة انتشرت على نطاق واسع عبر وسائل التواصل الاجتماعي، وهو يرتدي قبعة زرقاء على شكل أرنب أمام منزله، بينما يقف عملاء فيدراليون بالقرب منه، في مشهد أثار موجة واسعة من الغضب والتعاطف.
ووفقًا لمنطقة كولومبيا هايتس التعليمية العامة، كان ليام واحدًا من أربعة طلاب احتجزتهم سلطات الهجرة في وقت سابق من هذا الشهر في إحدى ضواحي مدينة مينيابوليس.
انتقادات حادة لسياسة الترحيل
وفي حكمه الصادر مساء السبت، وصف قاضي المحكمة الجزئية الأمريكية فريد بييري القضية بأنها نتيجة مباشرة لما سماه «السعي الحكومي السيئ التخطيط والتنفيذ لتحقيق حصص يومية للترحيل، حتى لو تطلب الأمر ترويع الأطفال».
وكتب القاضي: «في نهاية المطاف، قد يُجبر مقدمو الالتماس على العودة إلى وطنهم بسبب تعقيدات نظام الهجرة الأمريكي، سواء قسرًا أو عبر ترحيل ذاتي، لكن مثل هذه النتيجة يجب أن تتم ضمن سياسة أكثر تنظيمًا وإنسانية مما هو مطبق حاليًا».
لجوء قانوني واحتجاز عائلي
وكان الأب والابن، وهما من الإكوادور، قد دخلا الولايات المتحدة بشكل قانوني بصفتهما طالبي لجوء، قبل أن يتم نقلهما إلى مركز احتجاز عائلي في مدينة ديلي بولاية تكساس، بحسب ما أفاد محاميهما مارك بروكوش في تصريحات سابقة لوكالة رويترز.
مقارنة بإعلان الاستقلال
ووجّه القاضي بييري، الذي عُيّن خلال رئاسة بيل كلينتون، انتقادات لاذعة لإدارة الرئيس دونالد ترمب في حكمه المؤلف من ثلاث صفحات، مشبهًا ممارساتها بتصرفات الملك البريطاني التي وردت في إعلان استقلال الولايات المتحدة.
وأشار إلى عبارات تاريخية تتحدث عن «إرسال أسراب من الضباط لمضايقة الشعب»، و«إثارة الاضطرابات الداخلية»، و«إيواء قوات مسلحة كبيرة بين المدنيين».
تشكيك في قانونية الاعتقالات
وأكد القاضي أن الدستور الأمريكي يشترط أن يستند أي أمر اعتقال إلى سبب محتمل يحدده قاضٍ مستقل، منتقدًا ما يُعرف بـ«الأوامر الإدارية» التي تصدرها سلطات الهجرة نفسها.
ووصف هذه الممارسة قائلًا: «إنها أشبه بأن يُكلف الثعلب بحراسة بيت الدجاج».
وأضاف في لهجة شديدة: «مراقبة السلوك البشري تؤكد أن لدى البعض شهوة خبيثة للسلطة المطلقة، وميلاً لفرض القسوة بلا حدود أو أدنى قدر من الكرامة الإنسانية، وليذهب حكم القانون إلى الجحيم».
أطفال آخرون ضمن المداهمة
من جهتها، أوضحت زينا ستينفيك، المشرفة على المنطقة التعليمية، أن عناصر مسلحين وملثمين احتجزوا أيضًا مراهقين يبلغان 17 عامًا وطفلًا آخر عمره 10 سنوات، إلى جانب ليام، خلال العملية نفسها.
A U.S. federal judge ordered on Saturday evening the release of Adrian Coniglio Arias and his five-year-old son Liam Coniglio Ramos, after they were detained by immigration authorities during a raid conducted in Minnesota.
According to Reuters, the child Liam had appeared in a widely circulated photo on social media, wearing a blue rabbit-shaped hat in front of his home, while federal agents stood nearby, in a scene that sparked widespread outrage and sympathy.
According to the Columbia Heights Public Schools district, Liam was one of four students detained by immigration authorities earlier this month in a suburb of Minneapolis.
Sharp Criticism of Deportation Policy
In his ruling issued on Saturday evening, U.S. District Judge Fred Biery described the case as a direct result of what he called “the poorly planned and executed government pursuit of daily deportation quotas, even if it requires terrorizing children.”
The judge wrote: “Ultimately, petitioners may be forced to return to their home country due to the complexities of the U.S. immigration system, whether involuntarily or through self-deportation, but such an outcome should occur within a more organized and humane policy than what is currently in place.”
Legal Asylum and Family Detention
The father and son, who are from Ecuador, entered the United States legally as asylum seekers before being transferred to a family detention center in Dilley, Texas, according to their attorney Mark Brukosh in previous statements to Reuters.
Comparison to the Declaration of Independence
Judge Biery, who was appointed during Bill Clinton’s presidency, delivered a scathing critique of President Donald Trump’s administration in his three-page ruling, likening its practices to the actions of the British king mentioned in the Declaration of Independence.
He referenced historical phrases discussing “sending swarms of officers to harass the people,” “stirring up domestic insurrections,” and “housing large bodies of armed troops among civilians.”
Doubts About the Legality of Arrests
The judge emphasized that the U.S. Constitution requires any arrest warrant to be based on probable cause determined by an independent judge, criticizing what are known as “administrative warrants” issued by immigration authorities themselves.
He described this practice by saying: “It’s like assigning a fox to guard the henhouse.”
He added in a stern tone: “Monitoring human behavior confirms that some have a wicked craving for absolute power, and a tendency to impose boundless cruelty or the slightest degree of human dignity, and let the rule of law go to hell.”
Other Children Among the Raid
For her part, Zina Steinvik, the supervisor of the educational district, clarified that armed and masked individuals also detained two 17-year-old teenagers and another child aged 10, alongside Liam, during the same operation.
