لبنانية تهزم نقابة المهن الموسيقية المصرية.. قضائياً – أخبار السعودية – كورا نيو

أنهت محكمة القضاء الإداري جدلاً قانونياً استمر أشهراً، بعدما أصدرت حكماً بإلغاء قرار نقابة المهن الموسيقية القاضي بمنع الفنانة اللبنانية هيفاء وهبي من الغناء داخل مصر، معتبرة القرار مخالفاً للدستور والقانون. وقضت الدائرة الثالثة بمحكمة القضاء الإداري بإلغاء قرار المنع الصادر عن نقابة المهن الموسيقية في 16 مارس الماضي، الذي تضمن سحب تصاريح الفنانة ومنعها من إحياء الحفلات، بعد الطعن عليه لافتقاره إلى السند القانوني وتجاوزه حدود الاختصاص.

وجاء الحكم استناداً إلى تقرير هيئة مفوضي الدولة، الذي أوصى صراحة بإلغاء قرار النقابة، مؤكداً أن منع فنانة من ممارسة نشاطها الفني لا يجوز إلا بحكم قضائي، وأن ما صدر يُعد مساساً مباشراً بحرية الإبداع المكفولة دستورياً.

وكانت هيفاء وهبي، أقامت دعوى قضائية ضد النقابة، وتدخل فيها المحامي الحقوقي الدكتور هاني سامح، مطالباً بوقف تنفيذ قرار المنع وإلغائه، على أساس أنه يمثل اعتداءً على الحقوق الدستورية ويخالف مبادئ المشروعية وسيادة القانون.

من جهتها، عبّرت الفنانة هيفاء، عن سعادتها بالحكم، مؤكدة احترامها الكامل للقضاء المصري وثقتها في نزاهته، ومشددة على تقديرها للجمهور المصري وحرصها على الالتزام بالقوانين المنظمة للعمل الفني.

The Administrative Court has ended a legal controversy that lasted for months, after issuing a ruling to annul the decision of the Musicians’ Syndicate prohibiting Lebanese artist Haifa Wehbe from singing in Egypt, deeming the decision unconstitutional and illegal. The third circuit of the Administrative Court ruled to annul the prohibition decision issued by the Musicians’ Syndicate on March 16, which included revoking the artist’s permits and preventing her from holding concerts, after an appeal was filed against it for lacking legal grounds and exceeding jurisdiction.

The ruling was based on a report from the State Commissioners Authority, which explicitly recommended annulling the Syndicate’s decision, confirming that preventing an artist from practicing her artistic activity can only be done by a judicial ruling, and that what was issued constitutes a direct infringement on the freedom of creativity guaranteed by the constitution.

Haifa Wehbe had filed a lawsuit against the Syndicate, with human rights lawyer Dr. Hani Samah intervening, demanding the suspension and annulment of the prohibition decision, on the grounds that it represents an infringement on constitutional rights and violates the principles of legality and the rule of law.

For her part, artist Haifa expressed her happiness with the ruling, affirming her complete respect for the Egyptian judiciary and her confidence in its integrity, emphasizing her appreciation for the Egyptian audience and her commitment to adhering to the laws governing artistic work.
