أعادت النيابة العامة التذكير بأن الإفصاح عن البيانات الشخصية دون تصريح نظامي يُعد جريمة موجبة للمساءلة الجزائية، مؤكدة أن حماية الخصوصية تُعد من الركائز الأساسية التي كفلها نظام حماية البيانات الشخصية !
كلام واضح وصريح لا يحتمل أي التباس أو فهم خاطئ من أي أحد؛ بل إن حماية البيانات الشخصية، وحتى دون وجود نظام يحميها، تُعد من بديهيات الثقة والأمانة والمروءة. ومع ذلك نجد من يُهمل ذلك، فيُشارك بيانات الآخرين دون إذنٍ منهم، سواء في ممارسة أنشطة تجارية أو استقصائية أو حتى فردية !
ويُفاجَأ البعض في حالات كثيرة باقتحام خصوصية هاتفه الجوال أو بريده الإلكتروني عبر اتصالات تسويقية أو استقصائية أو احتيالية، تتصل بأنشطة تجارية قام بها مع أطراف أخرى، سواء عند شراء منتج أو انتظار طرد بريدي، متعجباً من هذا التوافق أو التصادف في التواصل. وهذه الأطراف الثلاثة التي تقوم بالاتصال لا يمكن أن تحصل على بياناتنا من الهواء، فلا بد أنها حصلت عليها من مصادر محددة !
وفي بعض الدول الغربية، خاصة في بعض الولايات الأمريكية، لا تحمي الأنظمة خصوصية البيانات بشكل حاسم، فتمارس بعض الجهات عملية بيعها لجهات أخرى تستفيد منها في الترويج لخدمات أو سلع. تتصل بشركة هاتف أو كهرباء أو تأمين، فتفاجأ بسيلٍ من الاتصالات والرسائل الترويجية التي تحاول اقتناصك وكأنك صيدٌ ثمين، وهذا بلا شك انتهاك أخلاقي قبل أن يكون انتهاكاً نظامياً للخصوصية !
كما أن بعض شركات العلاقات والتسويق تتاجر بالبيانات الشخصية، فتشتريها وتبيعها وفق تصنيفات الزبائن ومجالات أنشطتهم واهتماماتهم، ومن هنا تأتي أهمية ما نبّه إليه المشرّع السعودي بضرورة وجود نظام لحماية البيانات الشخصية، سابقاً بذلك العديد من الدول المتقدمة !
باختصار.. قد نستطيع تجاهل اتصالات المسوقين المزعجة، لكن الوعي يبقى ضرورياً لمواجهة الغفلة أحياناً عن رسائل الاحتيال الملغومة والانخداع بها !
The Public Prosecution has reiterated that disclosing personal data without legal authorization is considered a crime subject to criminal accountability, emphasizing that privacy protection is one of the fundamental pillars guaranteed by the Personal Data Protection Law!
This is clear and explicit language that leaves no room for misunderstanding or misinterpretation by anyone; indeed, protecting personal data, even in the absence of a law to safeguard it, is one of the basics of trust, integrity, and honor. Nevertheless, we find some who neglect this, sharing others’ data without their permission, whether in conducting commercial, investigative, or even individual activities!
Many are surprised in numerous cases by the invasion of their mobile phone or email privacy through marketing, investigative, or fraudulent communications, related to commercial activities they engaged in with other parties, whether when purchasing a product or awaiting a package, astonished by this coincidence or alignment in communication. These three parties that make contact cannot obtain our data out of thin air; they must have acquired it from specific sources!
In some Western countries, especially in certain U.S. states, the systems do not decisively protect data privacy, leading some entities to sell it to others who benefit from it in promoting services or goods. When you contact a phone, electricity, or insurance company, you are surprised by a flood of promotional calls and messages trying to capture you as if you were valuable prey, which is undoubtedly an ethical violation before being a legal violation of privacy!
Additionally, some marketing and relationship companies trade in personal data, buying and selling it according to customer classifications and their fields of activity and interests. This highlights the importance of what the Saudi legislator has pointed out regarding the necessity of having a system for the protection of personal data, ahead of many developed countries!
In short.. we may be able to ignore the annoying calls from marketers, but awareness remains essential to confront the occasional oblivion to fraudulent messages and being deceived by them!
